At Cueria Law Firm, we specialize in assisting clients with personal injury cases. If you have been injured, you may be wondering if you qualify to file a lawsuit for your injuries. Determining if you should file a personal injury lawsuit will be dependent on several factors. Every state is different, so the location of your injury will need to be considered. Our personal injury attorneys are based in Louisiana, so we fully understand the legal options for individuals who have been injured in the state. We also serve other areas in the US.

If you have been involved in a car accident, work injury, or injured in a public place, you may have a case. A common factor involving personal injury cases is negligence. Our New Orleans personal injury attorneys can assist in reviewing your case to see if the four basic components of a negligence claim are met to then file a claim on your behalf for compensation.

Four Basic Components of a Negligence Claim

To begin, you must be able to show that another person or entity owed you a duty regarding your injury. This factor should be easy to configure. Take for example a car accident. The driver that caused the accident had a duty to drive safely and if they were not, then they are at fault.

A second aspect to consider is a breach. You must be able to show that the duty owed to you was breached by the other individual due to their action or omission. Take for example a car accident scenario. If you are injured due to another person running a red light and they hit your car, they breached their duty by not operating their car in a safe manner.

Once you have a duty and breach covered, you will need to then prove that the duty was breached by the individual/company caused you to be injured.

Finally, you will have to show the court that you suffered an injury. This could be a physical injury, emotional trauma, financial burden, etc.

All of this may sound confusing, but our attorneys can easily assist by reviewing your case and reviewing each category to see if you have the ability to file for compensation.

If someone you care about or yourself have suffered an injury due to the negligent actions of someone else, give our office a call. Our Louisiana Personal Injury attorneys are glad to review your case and help you file a compensation claim for damages.
